Its a similar situation to the married guy getting caught out by a lover. I dont think it's ok to drag an innocent party into it for the sake of making you feel better about a bad situation. He may had too many drinks, bad day, who knows. It's not something illegal so therefore not something for an employer should deal with. To affect someone's livelihood may have repercussions far beyond a regrettable online one liner. It's easy to get caught up in the moment and write something that a few seconds later is regretted. Really, everyone in tweet world should calm the fuck down. Closest thing I've come to a tweet is having my breakfast cereal with far too many bird seeds in.

The guy is deploreable for saying it in a public arena in the first place but we have all said things we know we shouldn't have and regret saying in the cold light of day. As stated it wasn't on the worksite, in uniform etc etc so to me contacting his employer is going too far. Ridicule him, call him out but you can't ruin someone's livelyhood. I wouldn't dob him in to his employer myself, but I dont think it's going to far that someone else would. Dave from AGL sounds like a person of shit character and an A-grade wanker. I'm sure that he is precisely the sort of person that AGL would feel is inconsistent with their core values...regardless of wether he toes the line in the workplace. Maybe this will be a lesson to him( and others ) in his next job that being a shit cunt online or at home can have far reaching consequences. At least he'll still be alive for his next job. My father died of MND when I was 21. It's a cruel disease that slowly...or quickly...paralyzes the body, but leaves the mind alone. Reducing active people to thinking husks of flesh, unable to move or speak, before it eventually paralyzes the heart. My father was given 3 years when he was diagnosed...and 3 years it was. No more. It's a shit way to die. There's no glory in it...no enduring last words at the end. Fuck Dave from AGL. Hope he learns a lesson from this. Because Daniher is doing something honourable with his life while he still has one.

I respect and admire Neil Daniher. He has been a great ambassador for afl and also now for MND. I have one of the brain freeze beanies and wear it proudly during winter. As much as it’s horrible to hear some fuckwit poke fun at Neil’s disability, I think we need to be very very careful about what consequences the culprit should face, for this issue and many other similiar tasteless comments that pop up referring to people in public spotlight. Sure what he said was extremely insensitive and downright moronic, but alas, it’s his right to speak as he wishes. If everyone who has said some offensive comment or such is removed from their job, then not many people would still be employed, the old stone throwing Jesus comment. Perhaps if he was using AGL as the platform from which he spoke then that could be considered a breach of the companies directives, but if it was only from his personal page then I think his employers have no right to sack or reprimand him, if anything just a quiet word to him behind the scene to show they don’t support his actions. I’m sure the guy is going to cop enough vitriol from general public and peers. I’d hope Neil himself would not take anything from it, and just look at it from the perspective of, the guy is nothing but an ignorant, classless fuckwit and doesn’t deserve wasting energy thinking about.

Dave from AGL is a shit person because, with one public tweet, he chose to paint himself as one.He could be spending his weekends cooking food for Sydneys homeless for all I know....but that wouldn't make one cruel public comment "okay" in some sort of warped karmic balance of things. What he is "really" like is irrelevant. I and we don't need to know that...he's already spoken for himself in that regard.What's important here is that he chose to make his "joke" public. That he felt his thoughts were worthy of sharing with the rest of the world. It's that free-will thing again...and he exercised it, all right.Taking responsibility for our words and actions has been expected of every one of us since forever, and he's been sharply reminded of that. Lack of empathy can also exhibit itself as borderline behaviour, a common pattern of which to insert oneself into dramas. Or narcissism, where ones opinions are right and others must bend or be damned. Empathy would be to step into Dave's shoes as well as the other person. Empathy is non judgemental. Unconditional positive regard isn't just for people you like. And it doesn't condone or condemn. Too much hate and anger in the world, you could fight it with anger, hate, retribution if that floats your boat. Maybe I missed it, but I have not read anywhere that "Dave" was aware that the guy had MND. If he did know then he deserved everything he got (except for contacting his employer that is). However, if he did not know then it could be just an innocent mistake / passionate outburst. I certainly did not know, but I do not follow AFL. My question is "if Dave did not know he had MND, what would the reaction / response be" Should he be punished for being ignorant of the fact ?

Koolgrey you have a very personal attachment to this story, and you are obviously very upset. I don't recall ever seeing any posts from you with any vitriol at all, let alone on this scaleWhen you strip your argument down, though, you want to ruin a persons life - regardless of whether this person is in all other respects a nice person, (and he could be an absolute cunt but he could also be a nice bloke - you don't know and nor do I) over an ill-advised joke on a social media platform. Destroy their lives. There is a very good book on this titled ''So You've Been Publicly Shamed'' by Jon Ronson, which shows just how far these things can go. Adopting a scorched-earth ''burn their lives to the ground'' approach can be seen as a mob mentality, and online shaming has being compared more and more to the witch hunts from the days of yore. Like others have said, the employer should have been left out of it but there is also the caveat of his supposedly advertising who we works for on his Twitter profile which can change things. The company I work for is quite specific about this - if your social media profile mentions us in any way and you say stupid things, reprisals will be in order. This is probably quite similar I dare say to most employers' social media policies. So, if Dave does list his employer on his profile, then Dave is a tool. Does Dave deserve to lose his job? Not in my opinion. And besides, we all know it doesn't stop there - families get dragged into it as well. The knock-on effects are, in my opinion, disproportionate.

I was outraged but she informed me this is quite norm In case you're wondering yes in my business because our clients are the general public we naturally have policies in place (drug/Alcohol) and a Code of Ethics and Conduct and if they are breached there is instant termination due to the nature of my business..but being a obnoxious dickhead doesn't breach any policy or code but it does make you shake your head Luckily I haven't had to enforce it, yet repeat, Dave is douche and I'm sure he is copping heaps although a search of media tonight has not revealed publicly what his fate is. The mystery Dave posts a stupid offensive joke online. Someone tracks down his employer and dobs him in to them and the employer publically states they will take action. Will he like his job? Who knows, but it has happened before and if the mob creates enough heat then AGL might think that sacking Dave needs to happen. So out goes Dave, don't bother to clean your desk, the security guard will escort you off the premises now. I am guessing that Geelong isn't bursting at the seams with job opportunities right now, so Dave finds it hard to find another job. It isn't long before the bank comes knocking and, with no income to speak of, the inevitable repossession happens. So Dave has to start looking for a rental. Except he has no job, no income, and now a trashed credit rating, so no rental agency will touch him. Oh, did we mention his wife and two kids? They are homeless now too, because she had stayed home to look after the kids and she is not having any success landing work either. They have to take their kids out of school - the word about Dave has got around and the kids are being relentlessly bullied at school. So now not just Dave but his family are out on the street. And for what, because someone thought it was fun to inform his employer of a stupid joke? And if you think this is just hypothetical, ask yourself how long you could last if you lost your job tomorrow, you couldn't find work. your savings drain away, and banks and rentals didn't want to know about you. We live in times where so many are just looking for the slightest opportunity to be outraged, where the slightest transgression is unforgivable and brands you as the worst possible person until the end of your days. Well said mate. Totally agree. And I did chuckle at the “Dave’s not home” Cheech and Chong quote. I thought Fun420 might’ve got a smile from that himself, due to his namesake,tho sadly he seems to have taken this all to personally. If anything. I think it’s a good lesson in that we all need to be fkn careful about what we write on social media. It’s not just our mates next to us that hear what we say. If that was said pre the technology, most likely only a handful of people would have heard it. A good mate of his would’ve/should’ve told him to pull his head in, others would laugh. But the rest of the world would remain blissfully ignorant to the comment.

Bloody autocorrect! Here goes once more... lol So, the thing that might, and can cost him his job, is the fact he DID have AGL on his profile. That's like wearing your uniform in a public place. Therefore he's been caught out and dobbed on. This is like ppl who write to schools, about how their students may act in public, on their way to school, or home. The only thing that might, and can save him from losing his job, is someone went intentionally looking to dob them in, during non-working hours. Truly, AGL is not being represented by him at that time. For example, if someone had an offensive tattoo, and someone saw it in public, found where they worked, and complained, the company can't say to them to remove their shirt and show them. IMO, I feel he might be spoken to, and warned to be more aware of his actions in the future, but as disgusting as his comments were, they shouldn't be sackable unless he's broken work rules. When people don't speak up against things like Dave said, we run the risk of them becoming normalised. The fifty years of my life, is littered with outrageous normalised and accepted behaviour, that should never have been allowed to become so. .. Kool, I seem to remember you speaking of your father's passing before, however, not the MND, thank you for sharing and for an articulate forthright opinion. I'm sorry to hear your father's final years were chained by this crippling and horrific disease... I suffer from an incurable disease, although not MND. I have previously only spoken to Meander about this. I have been ridiculed, mocked, disparaged because of it, by people I know and people I don't know. Yes, words said without thought or care can inflict a pain of their own. .. We know someone who has MND, it has been so awful seeing their life taken away from them, step by step, over the last few years. Dreadful for the family too. Making fun, mocking such disability and disease is something I have no tolerance for. Able bodied people truly often don't know how lucky they are and how quickly their lives and health can change. The struggles involved with incurable, significant impact diseases, are challenging enough. And in this instance, it involves a man with an awful disease, doing his best, continuing to contribute in a positive way to society. .. On the Jay/AGL question, a few people have pointed out, that by Dave including his place of employment on his Social Media, he leaves himself open to recrimination, should the business involved decide to and as mentioned by some, many businesses now have policies in place that state there may be consequences to ill advised Social Media posts, that in some way link their name, and therefore their business Good Will, to that post or posts. There is No mention anywhere that he'll lose his job. We live in a changed world, get used to the new landscape. As for the ridiculous "free speech" argument, that's not what that is for. Some things are simply, Not a joke. Vamp., thanks for the definition, for the slow learners. What was okay decades ago, may not be so today. .. Billy was never one for being PC, however one of the few serious things he said was to never mock the afflicted. Say what ever you want, do what ever you want, just don't cry poor me when there are consequences. Additionally if the consequences involve third parties then it falls back on the initial transgression. It's also true that two wrongs don't make a right, and this appears to apply to this situation. Context always matters. As for never mocking the afflicted, sometimes the afflicted can do so themselves. I'm thinking of Steady Eddy among others. The point is, in these cases (stand up comedy) there is a limited and targetted audience. Even his jokes or references would be highly inappropriate and hurtful in a different context. In the OP case the person had no regard for who would be listening, which can be anyone, including the person being talked about, because it was done on a publicly accessible medium, it may as well have been a megaphone. However I also do not condone a religious style infinite punishment for finite crime approach. However as he made his comment public, it has the possibility to hurt many many people as opposed to saying it in person in a private group etc. I'm sure he's learnt his lesson now, regardless I'm sure others can learn from it also. - Posted from rhpmobile

The consideration shown towards Neale Danihers wife, children and extended family. Namely, not enough, frankly. Here's a dying man dedicating his remaining years to helping others, and too many people for my liking are bitching and moaning about "stupid jokes" taken too far, and "what if he loses his job and his house and blah, blah, blah.."Yeah? What if Neale's daughter Lauren can't take the denigration of her father anymore and cops a glass in the face one day? What if?Grown-up people live in the here and now...not the land of "what if." Schapelle Corby was imprisoned for 9 years in Indonesia for drug smuggling and she seems to be doing just fine. I hear she's just released her first single..12 months from now, no-one will remember who Dave-what's-his-name from AGL was. I'm sure he'll manage to land on his feet. And if he loses his job at AGL....so what? There will always be plenty of fish and chip shops or cafes in Geelong and surrounds in need of a hardworking kitchen-hand. Was lucky enough to work with an incredibly talented individual who had this condition...I think he would have said the remark was ignorant and foolish not to mention incredibly tasteless and that the individual concerned was ill educated or plain nasty but I seriously doubt he would have endorsed interfering with his employment.

You may look like Wonder Women but seriously. I absolutely disagree with the comment but I have not read anything on here that convinces me he new about the condition (just because he may be a tragic does not mean he actually knows what is going on). However, suppose we accept that he did know as I can't be bothered looking up the original tweet, then to me it just shows some evidence that he is either ignorant or just a bogen (or both), and I suspect that an intelligent well known legend would not be taking too much notice of Dave's comments. Therefore, although distasteful and wrong, If it were me I would not be giving it a second thought. Maybe I am wrong though. Has Neil Daniher or his family commented somewhere that they are very upset, or is it just social media that is outraged. I'm pretty sure they have more pressing things to worry about than some words on twitter. Taking offence on behalf of what you perceive others to think is ridiculous and creates this online crusader mentality that ruins lives. Context: A friend of mine had her father pass away from MND in 2010. Her only thought as the diagnosis was made was about his journey and the family's journey. What someone may have thought about it good or bad simply did not figure. So I think the only people taking offence here are the ones who are not directly affected but like to show off a sense of social morality which in the real world nobody has to that degree. It is then escalating into people losing jobs, families / children being negatively affected. But yes....that is justice. Online warriors go! Grow up people.

It’s already been established. Reread the Original post As for having shots at how someone looks in their profile pic, tad sad don’t you think ? A suggestion, how about discussing and debating the posts written not having cheap little narkies at peoples presentation, not cool Jason, suggest you google this story and see exactly how many people are outraged but perhaps you missed the whole point of the OP being not the original tweet but in Dave being reported to his employer for being a moron Should he be reported for a non related work incident, that’s the crux of the OP

I have re-read the original post and there is nothing in it that proves it has been "established" Happy for to point out exactly where it has been established. Still a stupid ignorant thing to say but I don't think a sackable offence. Was watching an old Western the other week and this guy was caught riding a horse with someone else's brand on so they hung him. Came out later the guy came across the horse as the cowboy had been killed by outlaws and was returning the horse to its owners. Too late though for the hung man. I reckon that is why we have a Court system with benefit of the doubt until proven otherwise. Could be wrong though. Secondly, your comment about "not having cheap little narkies at peoples presentation, not cool" is also incorrect. Appears people are very quick to jump to incorrect conclusions. My comment about SD looking like Wonder women was a compliment as I think she looks gorgeous. Or is me admiring a gorgeous women on RHP also offensive ?

As much as the guy is an uneducated troll, he really doesn't deserve to lose his job over an ignorant statement. I'm sure the backlash he'll be feeling already will be enough for him to regret his words. His employer has nothing to do with it, and I just think that it's the SJW's doing their SJW thing that have blown this further out of proportion that it needed. It has nothing to do with his work capacity or job performance, and unless it harms the business (i.e. if he's a spokesperson for the company, or regularly deals with public who may recognise him as being the ignoramus from Twitter), or unless it's part of a code of conduct in his contract, they've got no real recourse to discipline him. I actually think if they did fire him the fellow who got in touch with AGL might have something to answer for. Don't think for second that I condone his comment though, the guy is obviously a dick!

It would seem we all have a opinion on whether Dave’s a dick or not, but that is not the forum topic The forum topic is, did Jay cross a line by reporting Dave to his employer being AGL and does AGL have the right to reprimand Dave for what he does out of work hours ? Or another interpretation, you do something wrong out of work time, someone dobs you in to your employer and your employer tells that person they will be taking that up with you even if it’s not work related Did the dobber have the right ? Should your boss interfere in your down time activities if you are not trashing your employer in any way ? In other words, is the line between employer/employee blurred or is there a definite line that should not be crossed by the either party ? "Will be good for Melbourne fans to get to hear Daniher slur the words to the song one last time I guess" why would he randomly name Neale and make mention of slurring one last time if he didn't know Neale is afflicted with such a horrible disease? In my opinion Dave is a cold, heartless human and is a very sore loser. He deserves all the backlash he gets by making that disgusting comment in a public forum. However I do not see the need to involve his employer, it was not work related nor was he representing the business.

My only point was that there is a HUGE difference if the employer should be involved or not depending on if Dave knew about the condition prior. If he did not then it is just ignorant drunken frustrated statement thinking the guy drinks too much and doesn't coach very well (still wrong though but just bogon, uneducated drunken type talk), or the other is if he new about the condition then it borders on evil and maybe his employer should know about that sort of person. I like people making comments like Dave did, as it exposes what he’s probably really like. In a PC world where everyone wants to judge people, shit people are able to hide most of the time because they’re on their guard. I’d rather people were able to pretty much say and do what they like (in verbal actions) and then we can judge them for who they are and not what they may/may not actually be. Professional outrage does no good for society in my opinion, it just drives the nutters further underground until they explode. I’d rather see the dogs hit than accidentally step in it.

..It's important to remember, that often, saying nothing, is saying something.And that's mentioned a lot here in RHP land...that no reply IS a reply. I've learned that much in my time here. When we don't speak up and voice our opinions on what we view as injustices...by default, we are often condoning them.That if we don't do something, say ANYTHING, about antisocial behaviour in our society....then we are accepting it. There's far too much indifference to the shit elements of society, unfortunately....far too much, "It's not my problem"...when all that's needed is a voice. A few words.
